Tendo presente a matéria considerada assente na selecção de facto e a decisão oportunamente proferida após a produção da prova e discussão da causa, encontram-se demonstrados os seguintes factos:

Taking into account the matter considered undisputed in the selection of facts and the decision handed down in due course after producing the matter of evidence and discussing the case, the following facts are demonstrated :

1. Os autores Kate MacCann e Gerald MacCann são casados um com o outro [alínea A) dos factos assentes].
2. A autora Madeleine MacCann nasceu em 12.5.2003, sendo filha dos autores Kate MacCann e Gerald MacCann [alínea B) dos factos assentes].
3. O autor Sean MacCann nasceu em 1.2.2005, sendo filho dos autores Kate MacCann e Gerald MacCann [alínea C) dos factos assentes].
4. A autora Amelie MacCann nasceu em 1.2.2005, sendo filha dos autores Kate MacCann e Gerald MacCann [alínea D) dos factos assentes].
5. A autora Madeleine MacCann encontra-se desaparecida desde 3 de Maio de 2007, tendo sido aberto o inquérito criminal n.º 201/07.0GALGS pela Procuradoria da República do Círculo de Portimão [alínea E) dos factos assentes].

8. Os autores Kate MacCann e Gerald MacCann foram constituídos arguidos no inquérito criminal [alínea F) dos factos assentes].
9. A fls. 2587-2602 do inquérito criminal, em 10.9.2007, o Inspector Chefe Tavares de Almeida elaborou um relatório, do qual consta nomeadamente o seguinte:
“De todo o apurado, os factos apontam no sentido de que a morte de Madeleine McCann ocorreu, na noite de 3 de Maio de 2007, no interior do apartamento 5 A, do résort Ocean Club da Praia da Luz, ocupado pelo casal McCann e pelos três filhos. [fls. 2599 dos autos criminais] (…)
Por todo o exposto, resulta dos Autos que:
A) a menor Madeleine McCann morreu no apartamento 5 A do Ocean Club da Praia da Luz, na noite de 03 de Maio de 2007;
B) ocorreu uma simulação de rapto;
C) de forma a impossibilitar a morte da menor antes das 22H00, foi inventada uma situação de vigilância das crianças do casal McCann enquanto dormiam;
D) Kate McCann e Gerald McCann estão envolvidos na ocultação do cadáver da sua filha Madeleine McCann;
E) neste momento, parece não existirem ainda fortes indícios de que a morte da menor não tenha ocorrido devido a um trágico acidente;
F) do apurado até ao momento, tudo indica que o casal McCann, como autodefesa, não queira fazer a entrega de forma imediata e voluntária do cadáver, existindo uma forte probabilidade de o mesmo ter sido transladado do local inicial de depositação. Esta situação é susceptível de levantar questões quanto às circunstâncias em que ocorreu a morte da menor.
Assim, sugere-se a remessa dos Autos ao Exm.º Sr. Procurador da República, no círculo de Lagos, para:
G) eventual novo interrogatório dos arguidos Kate e Gerald McCann;
H) avaliar da aplicação de medida de coação que se julgar adequada ao caso. [fls. 2601 dos autos criminais]” [alínea AT) dos factos assentes].

8. The Applicants Kate and Gerry McCann were constituted arguidos in the scope of the police investigation [alínea F) of the undisputed facts]..
9. Pages 2587-2602 of the criminal investigation, 19.07.2007, chief Inspector Tavares de Almeida wrote a report in which the following section can be transcribed :
“From all that was gathered, the facts point in the direction that the death of Madeleine McCann occurred, on the night of May 3rd of 2007, inside the apartment 5A, of the Ocean Club resort, occupied by the couple McCann and by their three children;” (...)
“From all that was exposed, it results from the Autos that :
A) The minor Madeleine McCann died in the apartment 5A of the Ocean Club resort, on the night of May 3rd of 2007;
B) A simulation of kidnapping occurred ;
C) In order to turn impossible the death of the minor before 22H00, a situation of vigil of the McCann children while they slept was invented ;
D) Kate McCann and Gerald McCann are involved in the occultation of the cadaver of their daughter Madeleine McCann;
E) At the present moment, it seems that there are no strong indicia that the death of the minor wasn't due to a tragic accident;
F) From what was obtained until now, everything points out that the McCann, in self-defense, don't want to deliver immediately and voluntarily the cadaver, existing a strong possibility that the same was transported from the initial place of deposition. This situation is susceptible to raise questions about the circumstances under which the death of the minor occurred.
So we suggest that the 'Autos' be sent to the Public Prosecutor for Lagos, in order to proceed to :
G) an eventual new questioning of the arguidos Kate and Gerry McCann;
H) the evaluation of the measure of restraint to be applied in this case;” (p. 2601 of criminal Investigation Autos)

10. A fls. 2680 do inquérito criminal, em 10 de Setembro de 2007, o Procurador da República titular do inquérito proferiu um despacho, do qual consta nomeadamente o seguinte: 
“No desenrolar da investigação em que continua a investigar-se o desaparecimento da Madeleine McCann, estando portanto em aberto a investigação, quer para confirmar, quer para infirmar a sua ocorrência, relativamente aos crimes de rapto, homicídio, exposição ou abandono e ocultação de cadáver e conforme plano delineado, torna-se necessário documentar a hora real do referido desaparecimento, apurar a localização de cada um dos intervenientes, – desde o casal McCann ao grupo de amigos que com eles se encontravam de férias nos apartamentos turísticos Ocean Club na Praia da Luz: Jane Michelle Tanner, Russel James O’Brien, Matthew David Oldfield, Rachael Mariamma Jean Manpilly, David Anthony Payne, Fiona Elaine Payne e Diana Webster – à data dos factos e nos momentos posteriores, assim como determinar as movimentações dos arguidos Gerald McCann e Kate Healy, no período em que viveram em Portugal, estabelecendo também as conexões entre todos os intervenientes e terceiros. 
Nesse sentido e porque as diligências que a seguir se indicam se mostram essenciais para a descoberta da verdade, nomeadamente proceder à análise da informação do tráfego telefónico do casal McCann e seus amigos, bem como de outros números de telefone que se verificou estarem relacionados com os factos ocorridos na noite de 03 de Maio de 2007, remeta os autos ao Mmo. JIC.” [alínea AU) dos factos assentes].


10. Page 2680 of the criminal investigation, on 10th September 2007, the Public Prosecutor in charge of the case produced a dispatch that contains in particular the following :
“In the course of the investigation, where is stil investigated the disappearance of Madeleine McCann, being the investigation therefore open, either to confirm or infirm its occurrence (the disappearance) in relation to the crimes of abduction, homicide, neglect or abandonment and concealment of body and according to defined plan, it is necessary to document the real time of said disappearance, find out the precise location of each of the protagonists – from the McCann couple to the group of friends that were on holiday with them in the tourist apartments Ocean Club in Praia da Luz: Jane Michelle Tanner, Russell James O’Brien, Matthew David Oldfield, Rachael Marianna Jean Manpilly, David Anthony Payne, Fiona Elaine Payne and Diana Webster – when the event occurred and also after. There is also a need to determine the movements of the arguidos Kate and Gerry McCann for the time of their stay in Portugal while establishing all the connections between all the protagonists and third parties. In this sense, and because the diligences that will be pointed here after are essential to finding the truth, namely to analyze the telephone activity of the McCann couple and their friends, as well as other telephone numbers, that has been established were related to the facts that happened on the night of the 3rd of May 2007, refer the autos to the Mmo. JIC (Criminal Instruction Judge)”. [alínea AU) of the indisputable facts]


11. A fls. 3170 do inquérito criminal, em 3.12.2007, o Juiz de Instrução Criminal de Portimão proferiu um despacho, do qual consta nomeadamente o seguinte: 
“Por nos presentes autos se investigar a prática dos crimes de rapto, homicídio, exposição ou abandono e ocultação de cadáver, sendo os três primeiros punidos com pena de prisão superior a 3 anos e por se afigurar relevante a identificação da pessoa que revelou o comportamento suspeito ocorrido nas imediações do local onde desapareceu a criança e a que aludem os depoimentos de fls. 3150 e 3154 e ss., possuindo, assim, extrema relevância para a descoberta da verdade, os dados solicitados pelo Ministério Público, ordeno, (…) se solicite à operadora telefónica Portugal Telecom (…)” [alínea AV) dos factos assentes].


11. Page 3170 of the criminal investigation, 03.12.2007 by the Criminal Instruction Judge of Portimão produced a dispatch which mentions in particular the following :
“ Since in the current autos the crimes of abduction, homicide, abandonment and concealment of a body are being investigated being the first 3 crimes punishable with sentencing superior to 3 years and because it is relevant to identify the suspicious behavior observed in the surroundings of the place where the child disappeared from and mentioned in pages 3150 and 3154 and following of the case files , having so a high importance to the discovery of the truth , the data requested by the Public Ministry I order that (...) is requested from operator Portugal Telecom (...)” Point AV of the proved facts.

12. O réu Gonçalo Amaral foi, até ao dia 2 de Outubro de 2007, o Inspector da Polícia Judiciária encarregado da coordenação da investigação relativa ao desaparecimento da autora Madeleine MacCann [alínea G) dos factos assentes]. 

12. The Defendant Gonçalo Amaral was the Inspector of the Judiciary Police in charge of the coordination of the investigation into the disappearance of the applicant MBM [alínea G) of the indisputable facts]..

13. O réu Gonçalo Amaral ficou na situação de aposentado da Polícia Judiciária a partir de 1 de Julho de 2008 (artº 19º da base instrutória).
14. Em 21 de Julho de 2008 a Procuradoria-Geral da República divulgou uma “Nota para a Comunicação Social” anunciando que tinha sido determinado o arquivamento do inquérito referido no nº 5 e informando que o mesmo poderia vir a ser reaberto, por iniciativa do Ministério Público ou a requerimento de algum interessado, se surgissem novos elementos de prova que originassem diligências sérias, pertinentes e consequentes (artº 20º da base instrutória).
 
13. The defendant Gonçalo Amaral retired from the police force on the 1st July 2008 (art 19 of the instruction basis
14. On the 21st July 2008 the General Prosecution of the Republic divulged a note to the media announcing the archiving of the criminal investigation and that the same could be reopen by the initiative of the Public Ministry or any interested parties if new elements of evidence that would lead to pertinent diligences (article 20 of the instruction basis) .

15. No inquérito criminal foi proferido despacho de arquivamento pelo Procurador da República em 21.7.2008, consignando-se nomeadamente o seguinte:
Tendo em conta que havia determinados pontos dos depoimentos dos arguidos e testemunhas que revelavam, pelo menos aparentemente, contradição ou que careciam de comprovação física, foi decidido proceder-se à “reconstituição do facto”, diligência esta consagrada no artigo 150º do CPP no sentido de esclarecer devidamente e no próprio local dos factos os seguintes importantíssimos detalhes, entre outros:
1- A proximidade física, real e efectiva entre Jane Taner, Gerald McCann e Jeremy Wilkins, no momento em que a primeira passou por eles, e que coincidiu com o avistamento do suposto suspeito, transportando uma criança. Resulta, a nosso ver, estranho que tanto Gerald McCAnn como Jeremy Wilkins não a tenham visto, nem ao alegado raptor, apesar da exiguidade do espaço e da pacatez do local;
2- A situação relativa à janela do quarto onde Madeleine dormia, juntamente com os gémeos, a qual estava aberta, segundo Kate. Afigurava-se então necessário esclarecer se existia alguma corrente de ar, já que se menciona movimento das cortinas e pressão sobre a porta de entrada do quarto, o que seria, eventualmente, descortinável através da reconstituição;
3- O estabelecimento de uma linha de tempo e de controlo efectivo dos menores deixados sozinhos nos apartamentos, uma vez que a crer-se que tal controlo seria tão apertado como as testemunhas e os arguidos o descrevem, seria, pelo menos, muito difícil que se encontrassem reunidas condições para a introdução de um raptor na residência e posterior saída do mesmo, com a criança, mormente por uma janela com escasso espaço. Acresce que o suposto raptor só poderia passar, nessa janela, com a menor numa posição diferente (na vertical) à que a testemunha Jane Tanner o visualizou (na horizontal);
 15. In the archiving report, 21.07.08 (Astro is the translator) :
Taking into account that there were certain points in the arguidos' and witnesses' statements that revealed, apparently at least, contradiction or that lacked physical confirmation, it was decided to carry out the "reconstruction of the fact", a diligence that is consecrated in article 150 of the Penal Process Code in the sense of duly clarifying, on the very location of the facts, the following very important details, among others:
1 – The physical, real and effective proximity between Jane Tanner, Gerald McCann and Jeremy Wilkins, at the moment when the first person walked by them, and which coincided with the sighting of the supposed suspect, carrying a child. It results, in our perspective, strange that neither Gerald McCann nor Jeremy Wilkins saw her, or the alleged abductor, despite the exiguity of the space and the peacefulness of the area;
2 – The situation concerning the window to the bedroom where Madeleine slept, together with the twins, which was open, according to Kate. It seemed then necessary to clarify if there was a draught, since movement of the curtains and pressure under the bedroom door are mentioned, which, eventually, could be verified through the reconstitution;
3 – The establishment of a timeline and of a line of effective checking on the minors that were left alone in the apartments, given that, if it is believed that such checking was as tight as the witnesses and the arguidos describe it, it would be, at least, very difficult to reunite conditions for the introduction of an abductor in the residence and the posterior exit of said abductor, with the child, namely through a window with scarce space. It is added that the supposed abductor could only pass, through that window, holding the minor in a different position (vertical) from the one that witness Jane Tanner saw (horizontal);

4- O que aconteceu no espaço de tempo que mediou entre cerca das 18H45/19H00 – hora a que Madeleine foi vista pela última vez, no seu apartamento, por pessoa diferente (David Payne) dos seus pais ou irmãos – e a hora a que é reportado o desaparecimento por Kate Healy – cerca das 22H00;
5- As vantagens óbvias e consabidas da apreciação imediata da prova, ou por outras palavras, a concretização do princípio da imediação da prova em ordem à formação de uma convicção o mais firme possível sobre o presenciado por Jane Tanner e demais intervenientes e, eventualmente, arredar de vez quaisquer dúvidas que pudessem subsistir sobre a inocência dos pais da desaparecida.
Foram nesse sentido seguidos os procedimentos legais em conformidade com as normas e convenções em vigor, sendo solicitada a comparência das testemunhas, convidando-as a estarem presentes fazendo-se inclusivamente o apelo à solidariedade com o casal McCann, sendo certo que desde o início houve, da parte destes, adesão a tal diligência processual.
Contudo, não obstante as autoridades nacionais terem assumido todas as medidas para viabilizar a sua deslocação a Portugal, por motivos que se desconhecem, depois de várias vezes terem sido esclarecidas as muitas dúvidas que levantavam sobre a necessidade e oportunidade da sua deslocação, optaram por não comparecer o que inviabilizou a diligência.
Temos para nós que os principais prejudicados foram os arguidos McCann, que perderam a possibilidade de comprovarem aquilo que desde a sua constituição como arguidos têm protestado: a sua inocência face ao fatídico acontecimento; também estorvada restou a investigação, porque tais factos ficaram por esclarecer. (…)
Tal denota que os pais não estavam persistentemente preocupados com os filhos, que não iam fazer a sua verificação como depois declararam efectuar, antes negligenciaram, embora não temerária nem grosseiramente, o dever de guarda dos mesmos filhos. (…)
4 – What happened during the time lapse between approximately 6.45/7 p.m. – the time at which Madeleine was seen for the last time, in her apartment, by a different person (David Payne) from her parents or siblings – and the time at which the disappearance is reported by Kate Healy – at around 10 p.m.;
5 – The obvious and well-known advantages of immediate appreciation of evidence, or in other words, the fulfilment of the principle of contiguity of evidence in order to form a conviction, as firm as possible, about what was seen by Jane Tanner and the other interposers, and, eventually, to dismiss once and for all any doubts that may subsist concerning the innocence of the missing [child's] parents.
In this sense, the legal procedures were followed, according to the norms and conventions that are in force, and the appearance of the witnesses was requested, inviting them to be present inclusively appealing to solidarity with the McCann couple, as it is certain that since the beginning they adhered to that process diligence.
Nevertheless, despite national authorities assuming all measures to render their trip to Portugal viable, for unknown motives, after the many doubts that they raised about the necessity and opportunity of their trip were clarified several times, they chose not to attend, which rendered the diligence inviable.
We believe that the main damage was caused to the McCann arguidos, who lost the possibility to prove what they have protested since they were constituted arguidos: their innocence towards the fateful event; the investigation was also disturbed, because said facts remain unclarified. (...)
This shows that the parents were not persistently worried about their children [and] that they didn't check on them like they afterwards declared they did, rather neglecting their duty to guard those same children, although not in a temerarious, or gross, manner (...)

Se é um facto incontornável que a Madeleine desapareceu do Apartamento 5ª do Ocean Club, já não o é o modo e circunstâncias em que tal sucedeu – não obstante as muitíssimas diligências feitas nesse sentido – mantendo-se intocável o leque de crimes indiciados e referidos ao longo do Inquérito. (…)
No respeitante aos outros crimes indiciados não passam disso mesmo e pese embora se nos afigurar não ser de descartar, dado o seu elevado grau de probabilidade, a verificação de um homicídio, tal não pode passar de mera suposição por carência de elementos de sustentação nos autos.
O não envolvimento dos arguidos pais da Madeleine em qualquer actuação penalmente relevante parece resultar das circunstâncias objectivas de não estarem no apartamento aquando do seu desaparecimento, no seu comportamento normal adoptado até esse desaparecimento e posteriormente, como amplamente decorre do depoimento das testemunhas, da análise das comunicações telefónicas e também das conclusões das perícias, principalmente dos relatórios do FSS e do Instituto National de Medicina Legal.
A isso acresce que, na realidade, nenhum dos indícios que levou à sua constituição como arguidos veio a obter confirmação ou consolidação posteriores. Senão vejamos: não se confirmaram as informações de prévio alerta da comunicação social, em preterição das polícias, não se verificou a ratificação laboratorial dos vestígios assinalados pelos cães e as indicações iniciais do e-mail acima transcritas, mais bem esclarecidas posteriormente, vieram a revelar-se inócuas.
Ainda que, por hipótese, se admitisse que Gerald e Kate McCann pudessem ser os responsáveis pela morte da criança, sempre restaria por explicar como, por onde, quando, com que meios, com a ajuda de quem e para onde se libertaram do seu corpo no estrito espaço temporal de que, para tanto, teriam disposto. Acresce que a sua rotina diária até ao dia 3 de Maio se circunscrevera aos estreitos limites do aldeamento Ocean Club e à praia que lhe está adjacente, desconhecendo osm terrenos circundantes e, para além dos amigos ingleses que com eles aí veraneavam, não tinham amigos ou contactos conhecidos em Portugal. (…)
Foram realizados exames e análises em duas das instituições mais prestigiadas e credenciadas para o efeito – Instituto Nacional de Medicina Legal e o laboratório britânico Forensic Science Service – cujos resultados finais não valorizaram positivamente os vestígios recolhidos, nem vieram corroborar as marcações caninas. (…)
While it is an unavoidable fact that Madeleine disappeared from Apartment 5A of the Ocean Club, the manner and circumstances under which this happened are not – despite the numerous diligences made in that sense -, therefore, the range of crimes that were indicated and referred to during the inquiry remains untouched. (...)
Concerning the other indicated crimes, they are no more than that and despite our perception that, due to its high degree of probability, the occurrence of a homicide cannot be discarded, such cannot be more than a mere supposition, due to the lack of sustaining elements in the files.
The non involvement of the arguidos parents of Madeleine in any penally relevant action seems to result from the objective circumstances of them not being inside the apartment when she disappeared, from the normal behaviour that they adopted until said disappearance and afterwards, as can be amply concluded from the witness statements, from the telephone communications analysis and also from the forensics' conclusions, namely the Reports from the FSS and from the National Institute for Legal Medicine.
To this can be added that, in reality, none of the indications that led to their constitution as arguidos was later confirmed or consolidated. If not, let us see: the information concerning a previous alert of the media - before the police - was not confirmed, the traces that were marked by the dogs were not ratified in laboratory, and the initial indications from the above transcribed email, better clarified at a later date, ended up being revealed as innocuous.
Even if, hypothetically, one could admit that Gerald and Kate McCann might be responsible over the child's death, it would still have to be explained how, where through, when, with what means, with the help of whom and where to they freed themselves of her body within the restricted time frame that would have been available to them to do so. Their daily routine, until the 3rd of May, had been circumscribed to the narrow borders of the Ocean Club resort and to the beach that lies next to it, unknowing the surrounding terrain and, apart from the English friends that were with them on holiday there, they had no known friends or contacts in Portugal. (...)
- Tests and analyses were performed in two of the most prestigious and credentialed institutions for this effect – the National Institute for Legal Medicine and the British lab Forensic Science Service -, whose final results did not positively value the collected residues, or corroborated the canine markings; (...)

Não foi conseguido qualquer elemento de prova que permita a um homem médio, à luz dos critérios da lógica, da normalidade e das regras gerais de experiência, formular qualquer conclusão lúcida, sensata, séria e honesta sobre as circunstâncias em que se verificou a retirada da criança do apartamento, nem enunciar, sequer, um prognóstico consistente e inclusive – o mais dramático – apurar se ainda está viva ou se está morta, como parece mais provável. (…)
Assim, tudo visto, analisado e devidamente ponderado, face ao que se deixa exposto determina-se: (…) o arquivamento dos Autos quanto aos arguidos Gerald Patrick McCann e Kate Marie Healy, por não existirem indícios de os mesmos terem praticado qualquer crime. [alínea AQ) dos factos assentes].
- Despite all of this, it was not possible to obtain any piece of evidence that would allow for a medium man, under the light of the criteria of logics, of normality and of the general rules of experience, to formulate any lucid, sensate, serious and honest conclusion about the circumstances under which the child was removed from the apartment (whether dead or alive, whether killed in a neglectful homicide or an intended homicide, whether the victim of a targeted abduction or an opportunistic abduction), nor even to produce a consistent prognosis about her destiny and inclusively – the most dramatic – to establish whether she is still alive or if she is dead, as seems more likely.” (...)
“Therefore, after all seen, analysed and duly pondered, with all that is left exposed, it is determined:
b) The archiving of the Process concerning arguidos Gerald Patrick McCann and Kate Marie Healy, because there are no indications of the practice of any crime under the dispositions of article 277 number 1 of the Penal Process Code. (...)


16. A ré Guerra e Paz, Editores, SA é uma sociedade comercial, que tem por objecto designadamente a edição, publicação e comercialização, incluindo importação e exportação, de livros [alínea L) dos factos assentes].
17. Em 10 de Março de 2008, a ré Guerra e Paz, Editores, SA e o réu Gonçalo Amaral celebraram o acordo escrito junto a fls. 277-281, denominado “contrato de cedência de direitos de autor”, através do qual o réu Gonçalo Amaral cedeu à ré Guerra e Paz, Editores, SA, em exclusivo, por um período de 10 anos, os direitos para publicar o texto Madeleine, A Verdade da Mentira na forma de livro, impresso ou electrónico, em todas as línguas e para todo o mundo [alínea M) dos factos assentes].
18. A cláusula 4ª, n.º 1, deste acordo tem a seguinte redacção: “A retribuição a pagar pelo 1º outorgante ao 2º outorgante a título de direitos de autor relativamente às edições da obra para comercialização em Portugal será de: a) 12% do preço de capa de cada exemplar vendido, líquido de IVA, até 30.000 exemplares; b) 14% do preço de capa de cada exemplar vendido, líquido de IVA, a partir dos 30.001 exemplares vendidos até 50.000 exemplares; c) 16% do preço de capa de cada exemplar vendido, líquido de IVA, a partir dos 50.001 exemplares vendidos.” [alínea N) dos factos assentes].
19. A cláusula 5ª, n.º 2, deste acordo tem a seguinte redacção: “Se o 1º outorgante vender para outras línguas, em qualquer outro país do mundo, os direitos da obra, fica estabelecido que a receita líquida dessas vendas, após deduzidos os custos que decorram directamente da operação de venda, será dividido entre o 1º e o 2º outorgantes em partes iguais, ou seja, 50% para cada um” [alínea O) dos factos assentes].

16. The defendant Guerra e Paz is a commercial society and its activity consists of editing, publishing, trading, including import and export of books [alínea L) of the indisputable facts].
17. Nota introdutória
Este livro surge da necessidade que senti de repor o meu bom nome, que foi enxovalhado na praça pública, sem que a instituição a que pertencia há 26 anos, a Polícia Judiciária Portuguesa, tenha permitido que me defendesse ou que o fizesse institucionalmente. Pedi autorização para falar nesse sentido, pedido ao qual nunca recebi resposta. Respeitando rigorosamente os regulamentos da Polícia Judiciária, mantive-me em silêncio. Este, porém, era dilacerante para a minha dignidade.
Mais tarde fui afastado da investigação. Entendi então que era a hora de fazer a minha defesa pública. Para tal, pedi imediatamente a passagem à aposentação, de forma a readquirir a plenitude da minha liberdade de expressão.
Este livro tem ainda um propósito maior. O de contribuir para a descoberta da verdade material e a realização da justiça, na investigação conhecida como «Caso Maddie». Estes são valores fundamentais aos quais me obriguei por imperativo de consciência, por convicção e por disciplina à instituição a que tive o orgulho de pertencer. Estes mesmos valores não se extinguiram com a minha aposentação e continuarão a estar sempre presentes na minha vida.

Prologue
This book is rooted in the need I felt to restore my reputation, which has been undermined in the public arena, without the institution to which I have belonged for 26 years, the Portuguese Judicial Police, allowing me to defend myself or to do it institutionally. I asked permission to speak in this sense, that request remained unanswered. I strictly followed the rules of the PJ and I kept silent. This, however, lacerated my dignity.
Later I was removed from the investigation. I realised then that the time had come to defend myself publicly.
To achieve this, I immediately asked an early retirement, in order to regain the fullness of my freedom of expression.
This book has yet another major objective. That of contributing to the discovery of material truth so that justice is done in an investigation known as The Maddie Case. These are the fundamental values to which I subscribed by imperative of conscience, conviction and discipline regarding the institution to which I was proud to belong. My retirement will not extinguish these values, they'll go on being present in my life.
This book does not question the work of my colleagues in the police or compromise the ongoing investigation. It is my profound understanding that revealing all the facts, in this type of work, could jeopardise future operations, critical for the discovery of the truth. However, readers will discover data that they ignore, interpretations of facts - always in the light of law - and, of course, relevant questions.
A criminal investigation compromises only with the search for material truth. It should not be concerned about political correctness.

Muita coisa foi dita até ao momento – verdades e mentiras, assistindo-se, a par do dever de informação, a campanhas de desinformação que visaram descredibilizar a investigação criminal desenvolvida e os responsáveis pela mesma. Para mim a investigação estava morta desde 2 de Outubro de 2007, quando parecia ter vingado um novo ultimatum inglês no próprio dia em que se discutia o Tratado de Lisboa, pelo que já nada me admirava. Nos últimos tempos tinha assistido a mais um espectáculo mediático, um último forcing pela tese do rapto, com a divulgação por parte da família McCann de um retrato-robô de um presumível raptor. Já nada me surpreende.
— Não ligues. É Carnaval.
Prosseguimos com conversa de circunstância, mas senti que, definitivamente, o meu mundo tinha como que colapsado.
Depois de desligar, voltei a olhar para as amendoeiras, plantadas no chão duro algarvio, chão esse que pode ter tido influência na estratégia de ocultação de um cadáver e, pensei, não se teria Deus precipitado ao fazê-las florir no Inverno? [pag. 16] (…)
Um inquérito destinado ao arquivo
Tenho o pressentimento de que com aquela declaração o director nacional pretende preparar a opinião pública para o inevitável, ou seja, o fim da investigação e o arquivamento do inquérito. Essa parecia ser a estratégia adoptada em 2 de Outubro de 2007, a qual veio consolidar-se com a realização de diligências para cumprir calendário, um pouco para inglês ver. Temi logo que fosse colocada em causa a investigação realizada até ali, de forma a facilitar um eventual arquivamento. Esta investigação tinha vindo a desgastar a imagem da Polícia Judiciária, dos seus investigadores e de Portugal, e talvez por isso teria de terminar.
A constituição de Kate Healy e Gerald McCann, pais de Madeleine, como arguidos deveria ter sido o ponto de viragem na relação entre as polícias envolvidas e o casal. Se, quanto à polícia portuguesa, essa ruptura aconteceu, o mesmo parece não se poder dizer relativamente à polícia inglesa. Havia um entendimento entre ambas as polícias para avançar num rumo de investigação que encarava seriamente a possibilidade de a morte da criança ter ocorrido no apartamento mas, subitamente, a polícia inglesa inflectiu o rumo sem explicação técnica coerente – como adiante veremos. Causou-nos sempre estranheza a forma como o casal era tratado, mesmo após a sua constituição como arguido, e a informação policial a que eventualmente tiveram acesso.
Mentalmente, vou revendo a investigação, as recordações brotam em catadupa.
We were told many things so far - truths and lies - and there was, apart from the duty to provide information, disinformation campaigns aimed at discrediting the criminal investigation in development and those who were responsible for it. For me the investigation ceased to exist on October 2, 2007, when it appeared to have outweighed a new English ultimatum on the day of the summit on the Lisbon Treaty, so nothing surprised me more. The previous day I had attended an nth media spectacle, the ultimate forcing to the thesis of the kidnapping with the disclosure by the McCann family of a sketch of a suspected abductor. Nothing surprises me anymore.
- Do not pay attention. It's carnival.
We continued our convenient conversation, but I felt that my world had like collapsed for good.
After hanging up, I spotted again the almond trees, planted in the hard Algarvian ground, a soil that could have influenced the corpse concealment strategy and, I thought, wouldn't God have dashed in making them bloom in winter ? (p.16) (...)

An investigation destined for shelving

I have a feeling that with this statement, the national director intends to prepare the public opinion for the inevitable, i.e for the end of the investigation and the shelving of the case. That seemed to be the strategy adopted on 2 October 2007, which was consolidated with the execution of tasks to fulfil the calendar, a bit "for the English see" (for showing off) I feared immediately for the present investigation to be questioned so as to facilitate a possible shelving. This investigation had come to undermine the image of the PJ, its inspectors and Portugal, and that's why perhaps it had to be discontinued.
The constitution of Kate Healy and Gerald McCann, Madeleine's parents, as arguidos (by lawyer assisted witnesses) should have marked a turnaround in the relationship among the police forces and the couple. If, on the Portuguese police side, the break occurred, it seems that the same cannot be said of the English police. There was an agreement between the two police forces to move forward in an investigation that was seriously considering the possibility that the child died in the apartment, but suddenly the English police veered without consistent technical explanation - as we shall see further.
We have always found it odd the way the couple were treated, even after they got their arguido status, and their eventual access to police information.
I see the mentally investigation, the memories gush cascaded.

Penso principalmente naquela criança que, pouco antes de fazer 4 anos viu, de forma repentina, negado o seu direito à existência, a fazer-se mulher, a uma potencial vida de felicidade e sucesso na companhia dos seus familiares e amigos, que abruptamente se perdeu. Nada faz sentido. Parece estar a ser preparado um abafamento dos factos, diminuindo-se a força de todo e qualquer tipo de indício, esquecendo-se os direitos daquela e de outras crianças. Mas quem é que deseja este resultado? Quem exigiu a minha saída da coordenação operacional da investigação? Quem deseja o fim do estatuto dos McCann e de Murat como arguidos? Aqueles que insistem numa tese de rapto? Os que afirmaram, e adiante direi quem são, que por muito menos já tinham prendido pessoas em Inglaterra? Ou os que insistem na mentira esquecendo a busca da verdade material? A alguém há-de servir o eventual arquivamento do inquérito e o fim das investigações.
Depois da minha saída de Portimão em 2 de Outubro de 2007, tinha decidido esquecer o caso. Talvez fosse melhor, face aos poderes que parecem estar envolvidos.
Se as autoridades do país natal da criança pouco querem saber do que lhe aconteceu, alimentando a tese de rapto, porque terei eu de me preocupar? Não será uma declaração despropositada (ou induzida pela entrevistadora) de um director de polícia que vai conseguir apagar os indícios existentes (também não terá sido dita com essa intenção), o nosso trabalho está plasmado nos autos. Só destruindo-os é que se pode apagar o registo do que foi feito e, mesmo assim, resta-nos a nossa memória e a daqueles que connosco levaram a cargo a árdua tarefa de tentar descobrir a verdade material. Sim, morreu uma criança! E digo-o não por juízos de valor, mas por dedução fundamentada pela recolha de informações, indícios e provas de factos que estão plasmados nos autos. [pag. 21] (…)
A prudência de uma decisão
Já em Portimão, encontro o inspector-chefe Tavares de Almeida, que integrava a equipa que coordenei. Conhecemo–nos desde os tempos em que ingressámos na Polícia Judiciária. Está apreensivo com as palavras do director nacional, fala de um inquérito que já terá solicitado à Direcção Nacional da Polícia Judiciária. Para ele, o inquérito ao nosso trabalho virá repor a verdade.
— Durante os cinco meses em que nos mantivemos na investigação, ouvimos de tudo um pouco, mas fomos realizando o nosso trabalho.
I think mainly of this child about to be 4 years old, who all of a sudden was denied the right to existence, to become a woman, to a life of happiness and potential success in the company of her family and her friends, that was abruptly lost. Nothing makes sense. It seems that smothering the facts by decreasing the strength of any clue is being in preparation, forgetting the rights of this child and of others too. But who wants such an outcome ? Who demanded my removal from the operational coordination of the investigation ? Who wants to end the status of the McCanns and Murat as assisted witnesses ? Those who insist on the thesis of the kidnapping ? Those who claimed, and later I will say who they are, that people were arrested for much less in England ? Or those who persist in lying, forgetting the search for the material truth ? The possible shelving of the investigation and the end of the searches certainly favour someone.
After leaving Portimão, October 2, 2007, I decided to forget this case. It was perhaps better, given the powers that seemed to be involved.
If the authorities of the native country of the child are unwilling to know what happened to her, feeding the thesis of the kidnapping, why should I be concerned ? This is not the inopportune (or induced by the journalist) remark of a police director (that will erase the existing evidence (it was not the intent as well), our work is set in the stone of the autos. Would those be destroyed in order to erase what has been done, even then, we still have our memories and the memories of those who have carried out with us at arm's length the arduous task of trying to find the material truth ( pp.19-20) (…)

Yes, a child has died. And I do not say it by value judgment, but by deduction based on the collection of information, hints and proven facts contained in the autos. (p.21) (...)

The caution of a decision

At Portimão I meet Chief Inspector Tavares de Almeida, who was part of the team which I coordinated. We have known each other since we entered the PJ. The words of the national director worry him, he speaks of an investigation request, already filed with the national director of the PJ. He says the investigation of our work will restore the truth.

During the five months investigation, we heard a little of everything , but we have done our job.

Relembramos o que fizemos, com muito esforço e, honestamente, temos dúvidas que outros pudessem ter feito melhor. Não é presunção, é confiança no rigor do trabalho de todos os profissionais de polícia envolvidos:
— Ouve! Esta malta não sabe fazer contas? Como se pode falar de precipitação quando o casal foi constituído arguido quatro meses depois dos factos. Eles não conhecem o princípio da não auto-incriminação?
Referia-se à impossibilidade legal de continuar a recolher declarações de alguém, como testemunha, de forma a que esta dê a conhecer factos que a venham a incriminar. Ou seja, quando alguém está a prestar declarações sobre um determinado caso e, a dado momento, se verifica que esse cidadão terá um eventual envolvimento ou responsabilidade na prática de qualquer acto ilícito, é constituído arguido. Com isso o cidadão tem direitos e deveres. Curiosamente, e ao contrário do que se vê tantas vezes escrito na imprensa, sobretudo na inglesa, o arguido ganha protecção com a possibilidade de se remeter ao silêncio sem que com isso cometa um crime de falsas declarações – como seria o caso se ainda se mantivesse como testemunha.
— Concordo contigo. Se existem erros na investigação esse é um deles. O atraso em proceder à constituição do casal como arguido. Houve política a mais e polícia a menos.
— Bem, não diria tanto. O erro foi termos tratado o casal «com pinças». Bem sabes que desde muito cedo vimos que muita coisa não batia certo e eles foram tratados com privilégios. Isso é que não é normal! [pag. 23]
— Talvez o director nacional pense que o casal só abandonou o Algarve por terem sido constituídos arguidos.
— O casal foi ficando pelo Algarve, enquanto se falava da tese de rapto… quando tal tese foi colocada em causa, começaram logo a falar em regressar a Inglaterra.
— Donde se conclui que a sua constituição como arguidos foi um falso pretexto para abandonarem o nosso país.
— Sabes!? Houve jornalistas ingleses que consideraram Portugal um país do Terceiro Mundo… discordei e continuo a discordar, no entanto, só num país de Terceiro Mundo é que se afasta o responsável por uma investigação criminal em curso, sem que o mesmo tivesse sido posto em causa pela investigação que conduzia.
— Fala-se muito na governamentalização da justiça… esquece-se a forma como se pode influenciar uma qualquer investigação criminal…
We remember what we have done, the efforts and, honestly, we are not sure that others could have done better. This is not self-sufficiency, it is confidence in the rigour of the work of all police officers involved.
- Look ! These people, do they know how to sum things up ? How can one speak of precipitation when the McCann became assisted witnesses four months after the facts ? Do not they know the principle of non-self-incrimination ?
He was referring to the legal prohibition to take the testimony of a person as a witness  to the point where that person might let know facts that would eventually incriminate them. In other words, when someone is about to make statements on a specific case and when, at some point, it appears that this person might be involved or responsible for the practice of an unlawful act, this person has to be made arguido (a). So are preserved the rights and duties of citizens. Curiously, and contrary to what we see very often in the press, especially in the English media, the arguido status protects the (by lawyer) assisted witnesses, since they can keep silent and thus avoid making false statements - as in the case of a simple witness.
- I agree with you. If errors were made in this investigation, the delay in changing the status of the McCanns is one of them. There was too much politics and not enough police.
- Well, I wouldn't go that far. The error was to treat the couple "with tweezers". Remember how very soon we saw that many things did not fit and that the McCanns were entitled to privileges. That is not normal ! (p.23)
- Maybe the national director thinks that the McCanns left the Algarve because of the arguido status.
- They stayed in the Algarve as long as the abduction thesis was up-to-datexc ... When this thesis was questioned , they immediately started talking about returning to England.
- Hence we can conclude that the arguido status was only a pretext to abandon the country.
- You know, there are British journalists who believed that Portugal was a country of the third world ... I did not agree and I have not changed my mind, however only in countries of the third world the head of a ongoing criminal investigation is removed whereas he was not implicated by the investigation that he led. - There is much talk of governmentalization of justice ... we forget how influence can affect any criminal investigation.

— É fácil… distribui-se a investigação a pessoas da nossa confiança… ou então, se as coisas não correm bem, mudam-se os responsáveis pelas mesmas…
— Não me parece que tenha sido essa a razão de fundo, mas…
— Existem sempre argumentos válidos e legais… Enfim. O único obstáculo a essa gestão da investigação, quase política…são os dirigentes máximos das polícias.
É preciso que se oponham a situações dúbias e contrárias ao interesse da investigação. Não podem concordar com tudo só para ficarem agarrados ao poder…
— Companheiro… As pessoas não dirigem as polícias por interesses pessoais… dirigem-nas na prossecução do interesse público. Só assim se pode entender o papel das polícias num Estado democrático e de direito.
— Mas, olha!… Podemos chegar ao ponto em que determinadas investigações só serão realizadas por quem os arguidos quiserem…. talvez fosse uma questão de «modernidade».
— De modernidade ou de interesses… isto é tudo uma merda! [pags. 22-24] (…) 
Burla ou abuso de confiança?
Num momento de relaxe de uma destas reuniões, terei cometido um deslize ou, quiçá, terei sido inoportuno e pouco diplomático. Preocupado com a possibilidade de o casal McCann estar, de alguma forma, envolvido no desaparecimento de sua filha, e quando raciocinava quanto aos tipos de crime que os mesmos pudessem ter praticado, apercebi-me de um facto. Se, realmente, se viesse a confirmar qualquer tipo de responsabilidade do casal McCann, então poderia estar em causa, relativamente ao fundo criado para as buscas por Madeleine, que atingia mais de 2 milhões de libras, um crime de burla ou abuso de confiança. Abriu-se então o debate e, de facto, com as premissas indicadas, os crimes de burla qualificada ou abuso de confiança poderiam existir, mas Portugal não teria jurisdição para investigar e julgar por tal crime. Esta pertenceria ao Reino Unido, por o fundo se encontrar registado naquele país. Os colegas ingleses aperceberam-se então de uma dura realidade: a forte possibilidade de terem um crime para investigar no seu país, tendo como eventuais suspeitos o casal McCann, coisa que parecia não lhes agradar muito. Tendo-me apercebido de uma repentina palidez na face dos britânicos presentes. [pag. 193] (…)
 - It's easy ... Trustful police officers are made responsible for the investigation... Then, if things go wrong, the responsible ones are replaced ...
- I don't think it was the fundamental reason, but ...
- There are always valid and legal elements ... Finally. The only obstacle to the management of the investigation, almost political ... are the senior leaders of the police forces.
They must confront bad situations and contrary to the interests of the investigation. They may not agree with everything on the sole purpose of staying on to power ...
- My friend ... People do not direct the police forces for personal interest ... They lead in the pursuit of the public interest. This is the only way to understand the role of the police in a democratic State of law.
- But think a little! We can get to the point where only officers agreed by the arguidos will be in charge of some investigations ... It could be a question of 'modernity ' .

Fraud or breach of trust ?

During a relaxation moment in one of these meetings, I would have committed a gaffe or, who knows, been inconvenient and undiplomatic. Concerned with the possibility that the McCann couple might be, in one way or another, involved in the disappearance of their daughter, and as I reckoned the types of crimes that could be imputed to them, a fact came to my mind. Were the responsibility of McCann actually confirmed, then the crime of fraud or breach of trust concerning the fund created to search for Madeleine, a fund that held more than 2 million pounds, would follow. The debate was open and, in fact, the assumptions pointed to the aggravated fraud or breach of trust crimes, but it did not belong to Portugal to investigate and judge such a crime. It belonged to the UK, as the fund was registered there. Our English colleagues became then aware of a harsh reality: the strong possibility of a crime to be investigated in their country, having the McCanns as possible suspects, a prospect that did not seem to please them. I noticed the sudden pallor that invaded their faces. (p.193) (…)

Um desaparecimento, uma janela e um cadáver
Aqui chegados importa fazer uma síntese dedutiva sobre este caso. Ou seja, rejeitar o que é falso; afastar o que não se pode provar, por insuficiente; dar como válido e adquirido aquilo de que se fez prova.
Assim:
1.- A tese do rapto é defendida desde a primeira hora pelos pais de Maddie;
2.- No seio do grupo, apenas os seus progenitores declaram ter observado a janela aberta no quarto da menina desaparecida; a maioria não pode testemunhá-lo fielmente por ter acorrido ao apartamento já depois de ter sido dado o alarme;
3.- O único depoimento externo ao grupo que refere a janela aberta e os estores levantados, é o de Amy, uma das educadoras do Ocean Club, que aponta a sua observação para cerca das 22h20/22h30, logo, bastante depois de ser dado o alarme e não provando que aquela assim estivesse aberta à hora em que ocorreu o crime;
4.- O conjunto de depoimentos e testemunhos evidenciam um elevado número de imprecisões, incongruências e contradições – o que poderá ser tipificado, em alguns casos, como falsos testemunhos. Em particular, o depoimento-chave para a tese do rapto, o de Jane Tanner, perde toda a credibilidade por ter evoluído sucessivamente ao longo de vários momentos, tornando-se ambíguo e desqualificando-se;
6.- Há um cadáver não localizado, constatação validada pelos cães ingleses EVRD e CSI e corroborados pelos relatórios laboratoriais preliminares. [pags. 219-220]” [alínea I) dos factos assentes].
A disappearance , a window and a dead body

Reached this point, it is important to make a deductive synthesis of this case. In other words, reject what is false ; discard what you cannot prove for lack of sufficient evidence ; indicate as valid and established what was proven .
So :
1. The thesis of the abduction has been defended by Maddie 's parents since the first hour;
2. Within the group, only the parents claim to have seen open the window in the missing child's bedroom ; most ( travelling companions ) cannot reliably testify on this point, as they ran towards the apartment only after Kate McCann launched the alarm.
3. The only independent statement mentioning the open window and shutters was made by one of the Ocean Club nannies, Amy, who arrived at 22:20/30, pretty after the alert, turning hence her statement of no use for the crime time topic.
4. All statements and testimonies reveal numerous inaccuracies, incongruities and contradictions - some could even be described as false testimony. In particular the key-testimony for the abduction thesis, that of Jane Tanner, loses all credibility due to constant evolution which makes it ambiguous and disqualified .
6. There is a unfound body, an ascertainment confirmed by the English EVRD and CSI dogs and corroborated by laboratory's preliminary reports (pp.219-220)." (al.I)

Para mim e para os investigadores que comigo trabalharam no caso até Outubro de 2007, os resultados a que chegámos foram os seguintes:
1. A menor Madeleine MacCann morreu no apartamento 5-A do Ocean Club, da Vila da Luz, na noite de 3 de Maio de 2007;
2. Ocorreu uma simulação de rapto;
3. Kate Healy e Gerald MacCann são suspeitos de envolvimento na ocultação do cadáver da sua filha;
4. A morte poderá ter sobrevindo em resultado de um trágico acidente.
5. Existem indícios de negligência na guarda e segurança dos filhos [pags. 220-221] [alínea J) dos factos assentes].

The conclusions my team and I have arrived at are the following:
1. The minor, Madeleine McCann died inside apartment 5A of the Ocean Club in Vila da Luz, on the night of May 3rd 2007;
2. There was simulation of abduction.

29. Within the scope of the injunction attached there were only around 7.000 copies of the book delivered to the applicants legal representative [alínea V) of the indisputable facts].

32. A venda dos livros foi efectuada, em parte, à consignação e, noutra parte, em conta firme com direito a devolução, estando sujeita a devoluções por diversos motivos, nomeadamente, defeitos de fabrico, manuseamento ou não transacção (art. 23º da base instrutória).
33. O réu Gonçalo Amaral auferiu com a venda do livro Maddie A Verdade da Mentira, nos anos de 2008 e 2009, a quantia de Euros 342.111,86 (trezentos e quarenta e dois mil cento e onze euros e oitenta e seis cêntimos) (art. 3º e 4º da base instrutória).
  

31. The cover price of the book Maddie - the Truth of the Lie in Portugal was determined by the defendant Guerra&Paz on the amount of 13.33 € VAT included (art. 2º of the instruction basis).
32. The sale of the books was partly on consignment and another part subject to right of return for reasons such as faults, use or not being sold (art. 23º of the instruction basis).
33. The defendant Goncalo Amaral received the following amounts from the sale of the book: 2008 and 2009, the amount of 342,111.86 (art. 3
º and  4º of the instruction basis).

34. A ré V.C. – Valentim de Carvalho – Filmes, Audiovisuais, SA é uma sociedade comercial, que tem por objecto designadamente a criação, desenvolvimento, produção, promoção, comercialização, distribuição, exibição e difusão de obras cinematográficas e audiovisuais [alínea AA) dos factos assentes].
35. Em 7 de Março de 2008, o réu Gonçalo Amaral e a ré V.C. – Valentim de Carvalho – Filmes, Audiovisuais, SA celebraram o acordo escrito junto a fls. 282-283, denominado “opção de direitos – deal memo”, através do qual o réu Gonçalo Amaral cedeu à ré VC. – Valentim de Carvalho – Filmes, Audiovisuais, SA, em exclusivo, os direitos de adaptação audiovisual (documentário e ficção) de um livro sobre a investigação do desaparecimento da Praia da Luz [alínea AB) dos factos assentes].
36. Em 11 de Março de 2008, o réu Gonçalo Amaral e a ré V.C. – Valentim de Carvalho – Filmes, Audiovisuais, SA celebraram o acordo escrito junto a fls. 284-288, denominado “cessão de direitos – contrato de opção”, através do qual o réu Gonçalo Amaral cedeu à ré V.C. – Valentim de Carvalho – Filmes, Audiovisuais, SA, em exclusivo, por um período de dois anos, o direito de opção para proceder à adaptação do livro Maddie, A Verdade da Mentira para um documentário e ou ficção, que poderá ter o formato de um filme para cinema ou de um telefilme para televisão [alínea AC) dos factos assentes].
37. A cláusula 2 deste acordo tem a seguinte redacção: “Pela cessão desse direito exclusivo de opção, a VC Filmes obriga-se a pagar ao autor a importância ilíquida de €25.000, sujeita às taxas legais, e acrescida do IVA respectivo (…).” [alínea AD) dos factos assentes].

34. The defendant, VC Valentim de Carvalho is a commercial society that creates, develops, produces and promotes the exhibition and broadcast of cinematographic and audiovisual works.
35. On the 7th March 2008, teh defendant Gonçalo Amaral and the defendant Valentim de Carvalho signed a written agreement (add pages 282-283) designated concession of rights - Option of Rights – deal demo” through which the defendant GA gave up the exclusive rights of film adaptation (documentary and fiction) of a book about the investigation of the disappearance in Praia da Luz.
36. On the 11th March 2008, the defendant GA and the defendant Valentin de Carvalho signed a written agreement (284-288) , designated “Transfer of rights-Option contract” through which the defendant GA gave up to the defendant VCFilmes the exclusive option right for 2 years to adapt the book to documentary and/or fiction that may have the format of a film for cinema or a TV movie.
37. Clause 2 of this agreement states the following: By the transfer of these exclusive right of option, VC-Filmes compromises to pay the author the gross sum of 25.000, subject to legal fees and added VAT.

38. Da cláusula 4 deste acordo consta nomeadamente o seguinte: “1. Para a adaptação do livro a documentário, o autor obriga-se a participar como narrador, cedendo todos os direitos de imagem e de som. 2. Por essa participação, e pela cedência de todo o conteúdo patrimonial dos direitos de autor e conexos à VC Filmes, o autor receberá a importância ilíquida de € 15.000, sujeitos à taxa legal. (…) 3. Pela cedência dos direitos referidos no ponto anterior, o autor receberá 10% de todas as receitas, nacionais e internacionais, da exploração do documentário (em todas as plataformas e em todos os suportes inventados e a inventar) após dedução dos custos de produção.” [alínea AE) dos factos assentes].
39. A ré VC – Valentim de Carvalho – Filmes, Audiovisuais, SA acordou com a sociedade Valentim de Carvalho Multimédia, SA, em 6 de Junho de 2008, ceder a esta os direitos de comercialização, distribuição, exibição e difusão de um conjunto de obras cinematográficas e audiovisuais (filmes, mini-séries e documentários) que se propunha produzir num prazo de 5 anos (art. 30º da base instrutória).
40. A ré V.C. – Valentim de Carvalho – Filmes, Audiovisuais, SA produziu o documentário intitulado Maddie, A Verdade da Mentira, realizado por Carlos Coelho da Silva, que corresponde à adaptação da obra literária (livro) do réu Gonçalo Amaral, documentário esse que o DVD junto aos autos reproduz [alínea AF) dos factos assentes].

38. According to clause 4, and concerning the adaptation of the book into documentary, the author is obliged to participate as a narrator, transferring all image and sound rights. 2 For that participation and transfer of all the patrimonial content of author rights to VCFilmes the author will receive the gross sum of 15.000 euros, subject to legal fees. 3. For the transfer of rights mentioned in 2 the author will receive 10% of all receipts national or international receipts for the trading of the documentary (in all platforms and supports invented or yet to be invented) after deduction of production costs.
39. On 6/06/2008, the defendant VC- Filmes, Audiovisuais, SA agreed with VC Multimedia SA, to transfer to the latest all trading, distribution and exhibition and broadcast of a group of cinematographic and audiovisual works (film, mini-series, documentaries) that the latter intends to produce within 5 years.
40. The defendant VC produced the documentary Maddie , The Truth of the Lie , produced by Carlos Coelho da Silva , which is an adaptation of the book written by the defendant GA. This documentary, in DVD format, is appended  to the files.


41. No início do documentário, o réu Gonçalo Amaral afirma o seguinte:
O meu nome é Gonçalo Amaral e fui investigador da Polícia Judiciária durante 27 anos. Coordenei a investigação do desaparecimento de Madeleine MacCann no dia 3 de Maio de 2007. Nos próximos 50 minutos, vou provar que a criança não foi raptada e que morreu no apartamento de férias na Praia da Luz. Descubra toda a verdade sobre o que se passou naquele dia. Uma morte que muita gente quer encobrir. [alínea AG) dos factos assentes].
41. At the beginning of the documentary, the defendant Gonçalo Amaral states the following: 
My name is Gonçalo Amaral and I have been an inspector in the Judiciary Police for 27 years. I co-ordinated the investigation into the disappearance of Madeleine McCann on the 3rd of May 2007. During the next 50 minutes I will prove that the child was not abducted and that she died in the holiday apartment in Praia da Luz. Discover all the truth about what happened that day. A death that many want to cover up.

42. No final do documentário, o réu Gonçalo Amaral afirma o seguinte:
Aquilo que sei diz-me que Madeleine MacCann morreu no apartamento 5-A no dia 3 de Maio de 2007. Tenho a certeza de que esta verdade um dia será apurada. A investigação foi brutalmente interrompida e houve um arquivamento político e precipitado. Há quem esconda a verdade, mas mais tarde ou mais cedo, o verniz vai estalar e as revelações vão surgir. Só então haverá justiça para Madeleine MacCann. [alínea AH) dos factos assentes].

42. At the end of the documentary, the defendant Gonçalo Amaral states the following: 
What I know tells me that Madeleine McCann died in apartment 5A on the 3rd of May 2007. I am certain that this truth one day will be ascertained. The investigation was brutally interrupted and there was a hasty political archival. Some are hiding the truth but, sooner or later, the varnish will crack and  revelations will surface. Only then will there be justice for Madeleine MCCann.

43. A ré V.C. – Valentim de Carvalho – Filmes, Audiovisuais, SA concluiu o documentário com a seguinte declaração : 
O mistério persiste, o ex-inspector acredita que um dia se saberá a verdade. Por enquanto só sabemos que no dia 3 de Maio de 2007, Madeleine MacCann desapareceu na Praia da Luz. Tinha 3 anos de idade e era uma criança feliz.[alínea AI) dos factos assentes].
43. The defendant, Valentin de Carvalho –filmes Audiovisuais, SA concludes the documentary with this statement : 
The mystery remains, the former Inspector believes that one day the truth will be known. For now, we are aware only that on the 3rd May of 2007, Madeleine McCann disappeared in Praia da Luz. She was 3 years old and she was a happy child.

44. Na sequência de deliberação social tomada no dia 27 de Outubro de 2008 ocorreu um aumento do capital da ré VC – Valentim de Carvalho – Filmes, Audiovisuais, SA, o qual foi registado em 28 de Setembro de 2009, pelo qual o capital da mesma sociedade passou a ser detido, na proporção de 60% pela sociedade Estúdios Valentim de Carvalho – Gravações e Audiovisuais, SA e, na proporção de 40%, pelo Fundo de Investimento para o Cinema e Audiovisual (artº 29º da base instrutória).
45. Nos dias 13 de Abril de 2009 e 12 de Maio de 2009 o documentário foi transmitido pela ré TVI – Televisão Independente, SA [alínea AJ) dos factos assentes].

44. In the sequence of deliberations on the October 27, 2008, it was decided to increase the share capital of the defendant Valentim de CArvalho-Filmes Audiovisuais SA, an increase that was registered on the September 28, 2009, the capital of the company being held in the proportion of 60% by Estudios-Valentim de Carvalho-Gravações e Audiovisuais, SA and 40% by the Fundo de Investimento para o Cinema e Audiovisual.
45. On the 13th April 2009 and on the 12th May 2009 the documentary was broadcast by the defendant TVI-Televisão Independente SA.


46. Antes da emissão do documentário, a ré TVI – Televisão Independente, SA emitiu a seguinte declaração : 
O programa que se segue é um documentário baseado no livro de Gonçalo Amaral, ex-inspector da PJ que investigou o desaparecimento de Madeleine MacCann, no Algarve. A sua versão dos acontecimentos é repudiada pelos pais de Maddie, que continuam a defender tratar-se de um caso de rapto. O processo crime conduzido pelas autoridades portuguesas terminou com o arquivamento do inquérito, decisão contestada por Gonçalo Amaral. Mais do que apontar responsáveis, tarefa que incumbe à justiça, a emissão deste documentário destina-se a contribuir para que se faça luz sobre um caso que permanece um mistério por desvendar, há quase dois anos, e que se facultem elementos que ajudem a sua compreensão por parte da opinião pública. [alínea AL) dos factos assentes]
47. Pelo menos dois milhões e duzentas mil pessoas assistiram ao programa transmitido no dia 13.4.2009 (art. 10º da base instrutória).


46. Before the documentary’s broadcast, the defendant TVI-Televisão Independente SA issued this statement:  

The following program is a documentary based on the book by Gonçalo Amaral, former PJ Inspector who investigated the disappearance of Madeleine McCann in the Algarve. His version of events is denied by Maddie’s parents who continue to insist that it was an abduction. The criminal investigation carried out by the Portuguese authorities ended with the shelving of the files, a decision contested by Gonçalo Amaral. Rather than finding those responsible, a task for the justice system, the broadcast of this documentary aims at shedding some light and provide facts that might help understanding a case that has remained a mystery for almost two years. [alínea AL)
47. At least two million and two hundred thousand people watched the program broadcast on TVI 13.04.2009.

O réu Gonçalo Amaral deu uma entrevista ao jornal Correio da Manhã, conduzida pelos jornalistas Eduardo Dâmaso e Henrique Machado, publicada na edição de 24 de Julho de 2008, cujo teor se dá por integralmente reproduzido, com chamada de 1.ª página, tendo-lhe sido atribuídas nomeadamente as seguintes afirmações:
Correio da Manhã – Qual é a sua tese, como investigador do caso?
Gonçalo Amaral – A menina morreu no apartamento. Está tudo no livro, que é fiel à investigação até Setembro: reflecte o entendimento das polícias portuguesa, inglesa e do Ministério Público. Para todos nós, até ali estavam provadas: a ocultação do cadáver, simulação de rapto e exposição ao abandono.
Correio da Manhã – O que o levou a indiciar os McCann por todos esses crimes?
Gonçalo Amaral – Tudo começa numa teoria de rapto forçada pelos pais. E o rapto baseia-se em dois factos: um é o testemunho de Jane Tanner, que diz que viu um homem passar à frente do apartamento com uma criança ao colo; o outro é a janela do quarto que, segundo Kate, estava aberta quando devia estar fechada. Provou-se que nada disso aconteceu.
Correio da Manhã – Como é que se provou?
Gonçalo Amaral – Jane Tanner não é credível: identifica e reconhece pessoas diferentes. Começa por Murat, mais tarde fala-se noutra pessoa, pelo desenho feito por uma testemunha, e ela já diz que é aquela, completamente diferente de Robert Murat.
Correio da Manhã – O testemunho de Jane Tanner orientou a tese de rapto.
Gonçalo Amaral – Para se avançar por aí era preciso dar-lhe crédito: nada mais indiciava o rapto. E a questão da janela do quarto, onde Maddie e os irmãos dormiam, é fulcral. Leva à simulação. Isto é, se estava ou não aberta quando Jane diz que viu o homem de criança ao colo. A mãe da menina, Kate, é a única a falar na janela aberta.
Correio da Manhã – Isso desmonta a tese de rapto?
Gonçalo Amaral – Ali está a solução. Estar ou não fechada indicia fortemente simulação. E porque é que se simula rapto e não se diz que a criança desapareceu? Pode ter aberto a porta e saído…
Correio da Manhã – As impressões digitais de Kate reforçam a tese de simulação?
Gonçalo Amaral – São as únicas impressões digitais na janela. E em posição de forma a abrir a janela. (…)
48. The defendant Goncalo Amaral gave to the newspaper Correio da Manhã  an interview, conducted by the journalists Eduardo Dâmaso and Henrique Machado published on the 24th July 2008. Its contents is totally reproduced and announced on the front page, having been attributed to GA in particular the following statements :
CdMAs the case investigator, what is your thesis?
GAThe little girl died in the apartment. Everything is in the book, which is faithful to the investigation until September: it reflects the understanding of the Portuguese and the English police and of the Public Ministry. For all of us, until then, the concealment of the cadaver, the simulation of abduction and the exposure or abandonment were proved.
CdM — What led you to indict the McCanns over all of those crimes?
GA — It all started with the parents' pressure to impose an abduction theory. And the abduction is based on two facts: one is Jane Tanner's testimony that says she saw a man passing in front of the apartment, carrying a child (on his arms) ; the other is the bedroom window, which, according to Kate, was open when it should have been closed. It was proved that none of that happened.
CdM — How did you prove that ?
GA — Jane Tanner is not credible: she identifies and recognizes different people. She starts with Murat, then someone else is mentioned, according to the drawing done by a witness, and she says that is that person, somebody completely different from Robert Murat.
CdM — Does Jane Tanner’s testimony point towards the abduction theory ?
GA — In order to follow that direction, it would have been necessary to give her credit: there was no other abduction clue. And the window of the bedroom where Maddie and her siblings slept, is a vital issue. It leads to simulation. In other words, was it or not open when Jane says she saw the man carrying the child. The little girl’s mother, Kate, is the only person who mentions the open window.
CdM — Does this deconstruct the abduction thesis ?
GA — There lies the solution. The door closed or not is a strong clue for simulation. And why does one simulate abduction, rather than simply saying that the child has disappeared? She could have opened the door and left…
CdM — Do Kate’s fingerprints reinforce the simulation theory?
GA — They are the only fingerprints on the window. And in a position of opening it.

Correio da Manhã – O que é que na sua opinião aconteceu ao corpo?
Gonçalo Amaral – Tudo indiciava que o corpo, depois de estar num determinado local, foi movimentado de carro para outro, vinte e tal dias depois. Com os vestígios encontrados no carro, a menina teria de ter sido ali transportada.
Correio da Manhã – Como é que pode afirmar isso?
Gonçalo Amaral – Por aquele tipo de fluido, dizemos nós polícias, peritos, que o cadáver foi congelado ou conservado em frio e ao ser colocado na bagageira, com o calor que fazia na altura, parte do gelo derreteu. Numa curva, por exemplo, caiu alguma coisa do lado direito da mala, por cima da roda. Podem dizer que é especulação, mas é a única forma de explicar o que ali aconteceu.
Correio da Manhã – Se o corpo foi primeiro escondido na zona da praia esteve sempre fora do alcance das buscas?
Gonçalo Amaral – A praia foi batida a uma hora que não se sabe se o corpo ainda lá estava. Utilizando cães, mas os cães-pisteiros têm limitações, como a água salgada, por exemplo. Depois poderá ter sido removido”. [alínea Z) dos factos assentes]
CdM - What do you think happened to the body?
GA – Everything indicated that the body, after having been at a certain location, was moved into another location by car, twenty some days later. With the residues that were found inside the car, the little girl had to have been transported inside it.
CdM — How can you state that?
GA — Due to the type of fluid, we policemen, experts, say that the cadaver was frozen or preserved in the cold and when placed into the car boot, with the heat there was then, part of the ice melted. On a curb, for example, something fell in the boot's right side, above the wheel. It may be said that this is speculation, but it's the only way to explain what happened there.
CdM — If the body was hidden in the beach area first, was it always out of reach for the searches?
GA — The beach was searched at a time when it is not known whether the body was still there. Dogs were used, but sniffer dogs have limitations, like the salted water, for example. Later on, it might have been removed.(al.Z)

52. O DVD referido no número anterior foi editado e as cópias editadas foram comercializadas pela sociedade Valentim de Carvalho Multimédia, S.A mediante acordo celebrado com a sociedade Presselivre, Imprensa Livre, S.A (art. 8º da base instrutória).
53. Foram distribuídos para venda 75.000 exemplares do DVD [alínea AO) dos factos assentes].

58. A reprodução e a edição do documentário em formato vídeo foram autorizadas pela Valentim de Carvalho Multimédia, S.A. à sociedade Presslivre, Imprensa Livre, S.A., proprietária do jornal Correio da Manhã, conforme contrato entre ambas estabelecido. (art. 32° da base instrutória).
59. Nos termos do qual, os DVD, respectivas capas e embalagens seriam, como foram, fabricados por conta, ordem e sob a responsabilidade da Presslivre, para serem distribuídos e comercializados conjuntamente com o jornal Correio da Manhã. (art. 33° da base instrutória).
60. E todo o processo de registo e classificação da edição em vídeo (DVD) do documentário junto do IGAC seria, como foi, desenvolvido pela Valentim de Carvalho Multimédia, processo esse cujos custos a Presselivre suportaria, como suportou (arto 34o da base instrutória).
61. O DVD do documentário foi distribuído para venda em conjunto com a distribuição para venda do jornal Correio da Manhã (art. 35o da base instrutória).

63. O documentário foi reproduzido, inclusive legendado em língua inglesa, por terceiros que o difundiram na internet, sem a autorização e contra a vontade da ré VC. - Valentim de Carvalho – Filmes, Audiovisuais, SA (art. 36o da base instrutória).
64. Essa difusão ilícita prejudica não só os direitos de que a ré VC. - Valentim de Carvalho – Filmes, Audiovisuais, SA é titular sobre o documentário, como a respectiva exploração comercial, pois qualquer cidadão pode aceder ao documentário, também à distância de um “clic” (art. 37o da base instrutória).

80. Os factos relativos à investigação criminal do desaparecimento de Madeleine MacCann que o réu Gonçalo Amaral refere no livro, na entrevista ao jornal Correio da Manhã e no documentário são, na sua maioria, factos ocorridos e documentados nessa investigação (artos 27o e 28o da base instrutória).
81. Em consequência das afirmações do réu Gonçalo Amaral no livro, no documentário e na entrevista ao Correio da Manhã, os autores Kate MacCann e Gerald MacCann sentiram raiva, desespero, angústia,preocupação, tendo sofrido insónias e falta de apetite (arto 13o da base instrutória).

83. Os autores Kate MacCann e Gerald MacCann sentem, com muita preocupação, a necessidade de afastarem os filhos mais novos do conhecimento da tese referida no número anterior (arto 15o da base instrutória).
84. Sean e Amelie MacCann ingressaram na escola em Agosto de 2010 não tendo ainda tomado conhecimento da tese do réu Gonçalo Amaral referida no mesmo número (arto 17o da base instrutória).
